what's the answer to that problem?

One answer would be to declare the gallery areas as ground under repair, and establish mandatory drop zones (in the rough) every 15 yads or so.

regarding trampled down grass, well sometimes it can hurt you- remember's Phil's wayward drive on 18 at Winged Foot landed in trampled down grass in the gallery, it was a very good lie, such that Mickelson felt he could cut it around the trees and reach the green, we all know how that turned out. If his ball had been in thick rough he would have layed up and probably made bogey to force a playoff or even made par to win outright.
